Brett has had many years of experience in a broad range of maritime matters.
This has included work for large, commercial shipping companies, government entities, and family office/individual owners of smaller, commercial or privately held vessels, negotiating commercial agreements with vendors, suppliers, insurers, brokers, shipyards and related consultants, negotiating contracts for acquisitions of new and existing maritime vessels, collaborating with key stakeholders within relevant organizations and related.
By way of example, Brett’s work has included the many challenges of international shipping of goods for a purchaser that was in bankruptcy processes in the United States.
The project involved representing Sinosure for a number of years – the Chinese government export credit and insurance corporation – and approximately 15 China-based bicycle manufacturers during the bankruptcy process of the United States’ based Huffy Corporation, and in particular, the title to goods while in transit and transfer of title pursuant to INCO terms, protection of payment obligations by way of letters of credit and other instruments, bills of lading, customs declarations and other matters facilitating the clearance of goods through the Port of Los Angeles, U.S.A.
Brett also worked closely with a client that provided crude oil and refined petroleum shipping services for a number of years. The client had approximately 42 vessels in its fleet (Suezmax, Handysize, Panamax and other vessels, mostly flagged in the Martial Islands, each under a separate LLC entity) aggregating approximately 3.6 million dwt. With such client, he completed $’00s millions in capital raising transactions on the NYSE as well as privately, assisted with acquisitions of new and existing vessels with financing arrangements from banks in Germany and elsewhere, and many other matters.
As a ship’s captain in his own right, Brett holds certificates of competency with the Australian Maritime Safety Authority (both Master of Vessel and Marine Engine Driver for commercial vessels), and holds a Yachtmaster (Offshore) rating with the United Kingdom-based Royal Yachting Association.
